1. Service Overview

NanoBanana is an AI-powered image generation platform that enables users to create unique images using artificial intelligence technology. Our service includes:

  • AI image generation using advanced models (Nano Banana, Nano Banana Pro)
  • Image editing and enhancement features
  • Cloud-based storage for generated images
  • Credit-based usage system

2. Eligibility

To use our service, you must:

  • Be at least 13 years of age (or the minimum legal age in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the service under applicable laws
  • Provide accurate and complete registration information

3. Account Registration & Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • One account per person; multiple accounts may result in termination
  • You are responsible for all activities that occur under your account

4. Credits & Payment

4.1 Credit System

  • Our service operates on a credit-based system
  • Credits are consumed when generating images (rates vary by model)
  • Free users receive limited daily generations (IP-based tracking)
  • Purchased credits do not expire

4.2 Subscriptions

  • Subscription plans renew automatically unless cancelled
  • You may cancel your subscription at any time
  • Unused credits from subscriptions expire at the end of the billing period

4.3 Refunds

  • Refund requests must be made within 7 days of purchase
  • Credits that have been used are non-refundable
  • Refunds are processed to the original payment method

5. Intellectual Property Rights

5.1 Your Content

  • You retain ownership of the images you generate using our service
  • You are granted a perpetual, worldwide license to use generated images
  • Commercial usage rights depend on your subscription level

5.2 Our Content

  • Our platform, technology, and branding remain our exclusive property
  • You may not copy, modify, or distribute our software or services

6. Prohibited Content & Activities

You agree NOT to use our service to generate:

  • 🚫 Child sexual abuse material (CSAM) or any content sexualizing minors
  • 🚫 Non-consensual intimate imagery or deepfakes of real individuals
  • 🚫 Content promoting violence, terrorism, or hate speech
  • 🚫 Content that infringes on intellectual property rights
  • 🚫 Fraudulent or deceptive content intended to mislead others
  • 🚫 Malware, spam, or any malicious code
  • 🚫 Content violating any applicable laws or regulations

⚠️ Violations may result in immediate account termination and reporting to law enforcement.

7. AI-Generated Content Disclaimer

  • AI-generated images may contain errors, inaccuracies, or unexpected results
  • We do not guarantee the accuracy, quality, or appropriateness of generated content
  • You are solely responsible for reviewing and using generated images
  • We recommend human review before using images for commercial purposes
  • Generated content does not represent the views or opinions of NanoBanana

8. Service Availability

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • We may modify, suspend, or discontinue features with reasonable notice
  • API rate limits may apply to prevent abuse

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our service is provided "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid in the past 12 months
  • We are not responsible for third-party services or content

10. Indemnification

You agree to indemnify and hold harmless NanoBanana and its affiliates from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate or upload

11. Account Termination

  • You may terminate your account at any time through account settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your access to the service will cease immediately
  • We may retain certain data as required by law

12. Changes to Terms

  • We may update these Terms at any time
  • Material changes will be notified via email or service announcement
  • Continued use after changes constitutes acceptance of new Terms
  • If you disagree with changes, you must stop using the service

13. Governing Law

These Terms are governed by the laws of the Republic of Korea. Any disputes shall be resolved in the courts of Seoul, Korea.
